Pedestrian Killed Monday by Motorist

Lois Elain Barker from Rancho Cucmonga died on Monday when she was crossing Foothill Boulevard, near Lion Street, when she was struck by a car who was not paying attention. The driver of the vehicle is a 33 year old resident of Fontana.

Section 21950 of California Vehicle Code states “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk…” And the driver “shall exercise all due care and shall reduce the speed of the vehicle….”

If the driver is determined to be at fault, he/she could be found liable for the woman’s death. The family of the victim may file a wrongful death claim and recover damages for medical costs, funeral expenses, loss of income, support and companionship.
